Mitchell appears regularly in the District Court conducting criminal prosecutions, as well as advising and representing public regulatory bodies. Having the designation of Intermediate Crown Prosecutor from the Crown Law Office, he handles violent, sexual, drug and public order related offending. He also undertakes appeal work in the High Court for both the Crown and New Zealand Police. 

Mitchell has been seconded to a number of public sector agencies to bring his prosecution experience, including the:

  • Accident Compensation Corporation;

  • Coroner for the first stage of the Christchurch Masjidain Attack Inquiry; and

  • New Zealand Defence Force to assist the military police in undertaking investigations and exercising their powers.

Before joining the firm in 2020, Mitchell was a Judge’s Clerk at the Court of Appeal.

Recent and notable work

  • Second Counsel in the 2025 prosecution relating to Restore Passenger Rail’s protest activity in Wellington in 2023 and 2024.

  • Defending the Firearms Safety Authority in appeals against their firearms licensing decisions.

  • Prosecuting the import and export of thousands of objectionable publications to and from New Zealand.

  • Advising on, and prosecuting, wage subsidy fraud for the Ministry of Social Development.
